You must agree to the following terms and conditions of use before you access or otherwise use or participate in the Mondelēz International Online Community.  Your use of this web site constitutes your agreement with Mondelēz International to be bound by, and to act in accordance with, these Terms and Conditions.

 

Notification of Changes

 

We may change or revise these Terms and Conditions from time to time by updating this posting.  Please visit the Terms and Conditions area each time you visit the web site to keep up to date with the current terms regarding your use of the web site.  Your use of the web site reaffirms your continuing agreement to the then-current Terms and Conditions.  Any future changes to these terms and conditions will be posted on the community web site.

 

Confidentiality

 

Your invitation to participate in the Mondelēz International Online Community is personal and non-transferable. By participating in this Mondelēz International Online Community, you hereby agree to keep all information disclosed to you in the community, including any products, services, ideas, concepts, packaging, and advertising, completely confidential and further agree not to disclose such information to any other party nor to attempt to take, copy, remove, print, record or download any materials, notes, questionnaires, videos, charts or other information from the community. You agree that you will use the information disclosed to you only for the purpose of the research study within the Mondelēz International Online Community.

 

If a project within the Mondelēz International Online Community involves participation at home by members of your household, you agree that the members of your household are also under the same obligation of confidentiality and use.

 

In addition you agree that you and others in your household do not work in the food, market research or advertising industries.

 

You also understand that this agreement is legally binding and any breach may be grounds for legal action against you.

 

• Your community member name and password are for your use only.  You may not disclose your password to any other person. 

 

Material You Submit

 

All comments, suggestions, graphics, ideas (including product and advertising ideas), and other information or materials you submit to Mondelēz International through this web site will become and remain the exclusive property of Mondelēz International, including any future rights associated with such submissions, even if these Terms and Conditions are later modified or terminated.  This means that you cannot sue us for using any ideas or other materials you submit, and Mondelēz International unrestricted right to use them (or materials or ideas similar to them) for any purpose in any medium, now and in the future, without notice, compensation or other obligation to you or any other person.   It also means that Mondelēz International has no obligation to keep your submissions confidential. 

 

You further release and waive all claims against Mondelēz International with respect to any intellectual property or other proprietary rights, rights of privacy and publicity, rights of attribution, or any other liability under the governing law of the United States.

 

You also acknowledge that you are responsible for any submissions you make – in other words, you have full responsibility for the message, including its legality, reliability, appropriateness, originality and copyright

 

As a community member you will have the option of posting pictures in the community as a way to get to know other members and as a way to participate in research projects.  You do not have to share pictures to participate in the community.  However if you do choose to share your pictures as a member, the following Terms and Conditions apply.

 

You give permission to Mondelēz International, Inc., its parent, subsidiaries, affiliates, licensees, successors and assigns, and those acting under their authority (collectively, “Mondelēz”), to use pictures in internal and external business presentations.

You agree not to upload, post or transmit to or distribute or otherwise publish through the Web Site any materials which (i) restrict or inhibit any other user from using the Web Site, or contain a virus or other harmful component, (ii) violate any United States laws or violate or infringe any rights of third parties (including copyright, trademark, rights of privacy or publicity or any other proprietary right), or (iii) are not appropriate or pertinent to the purpose of the Web Site or are libelous, defamatory or offensive.  You will agree to abide by the copyrights, trademarks and other intellectual property and proprietary rights of Mondelēz International.

 

You agree to abide by these rules of conduct:

• Only those who are members of the community may access it.
• You agree not to use behavior that does not support a safe and comfortable environment for all members, or to engage in any proselytizing or commercial activity.
• You agree to receive emails from the Community regarding Community Activities.
• Mondelēz International does not endorse the information posted in the community by any community member.

 

Membership

 

Your membership in and access to the Mondelēz International Online Community is strictly at the discretion of Mondelēz International and may be revoked at any time without cause and without notice. You hereby release Mondelēz International from any and all liability that may arise in connection with your use of the Mondelēz International Online Community.

MONDELĒZ INTERNATIONAL DOES NOT REPRESENT OR ENDORSE THE CORRECTNESS, ACCURACY, RELIABILITY OR ANY OTHER ASPECT OF ADVICE, OPINION, STATEMENT OR OTHER INFORMATION DISTRIBUTED THROUGH THE MONDELĒZ INTERNATIONAL ONLINE COMMUNITY, AND RESERVES THE RIGHT TO REMOVE ANY CONTENT FROM THE COMMUNITY WEBSITE THAT IT DEEMS INAPPROPRIATE.

Jurisdiction

 

These Terms and Conditions and any disputes arising under or related to these Terms and Conditions (whether for breach of contract, tortuous conduct or otherwise) will be governed by the laws of the State of Illinois, without reference to its conflicts of law principles.  You agree to submit to jurisdiction in Illinois and further agree that any cause of action arising under this Agreement may be brought in a court in Cook County, Illinois, and you hereby accept and submit to the personal jurisdiction of these courts with respect to any legal actions, suits or proceedings arising out of these Terms and Conditions.  You also waive to the fullest extent permitted by law any right to a trial by jury in any action, suit or proceeding brought to enforce, defend or interpret any right or remedies under, or arising in connection with or relating to, these Terms and Conditions
