Member Agreement/Terms and Conditions

You must agree to the following Terms of Use before you access or otherwise use or participate in the Tom’s of Maine Online Community. Any future changes to these Terms of Use will be posted on the Tom’s of Maine Online Community web site. Your continued use of the Tom’s of Maine Online Community constitutes your acceptance of all changes to these Terms of Use. The Community is provided by Tom’s of Maine and a third party provider of Tom’s of Maine, and is made available to you free of charge (however, you will be responsible for all telephone or Internet access charges related to connecting to the Tom’s of Maine Online Community).

The Tom’s of Maine Online Community is a select group of people who share their insights, needs, challenges and opinions so that Tom’s of Maine can continue to learn more about what is important to its customers and consumers in an effort improve its products. From time to time, we will be inviting members to try new products, participate in activities and participate in a forum for interesting conversations with one another.

In return for your participation in the Tom’s of Maine Online Community, you may not disclose to others any of the information that we disclose to you or any ideas or information that are generated in the community. In addition, you assign to Tom’s of Maine all rights in any ideas or expressions of ideas that you provide to the community. You also release and waive all claims against Tom’s of Maine with respect to any intellectual property or other proprietary rights, rights of privacy and publicity, and rights of attribution. Furthermore, Tom’s of Maine does not represent or endorse the correctness, accuracy, reliability or any other aspect of advice, opinion, statement or other information distributed through the Tom’s of Maine Online Community. 

All of the information you submit when you register for the Tom’s of Maine Online Community will be treated in accordance with Tom’s of Maine’s privacy policy a copy of which is available at http://www.tomsofmaine.com/privacy

Your membership in and access to the Tom’s of Maine Online Community is strictly at the discretion of Tom’s of Maine and may be revoked at any time without cause and without notice. You will be given a user ID and password, and you will not be permitted to allow any other people access to the community using your ID and password, nor will you be permitted to disclose your user ID and password to any other person.

You agree not to (i) upload, post or transmit to or distribute or otherwise publish through the Tom’s of Maine Online Community any materials that (a) restrict or inhibit any other user from using the web site, or contain a virus or other harmful component, (b) violate any laws or violate or infringe any rights of third parties (including copyright, trademark, rights of privacy or publicity or any other proprietary right), or (c) are not appropriate or pertinent to the purpose of the Tom’s of Maine Online Community or are libelous, defamatory or offensive; or (ii) use any other member's information, personal or otherwise, for any commercial purpose or to obtain direct financial gain (e.g. mass marketing); or (iii) post or transmit to the Tom’s of Maine Online Community any unsolicited advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or any other form of solicitation.

You agree to abide by the copyrights, trademarks and other intellectual property and proprietary rights of Tom’s of Maine, by suppliers or licensors of Tom’s of Maine and any other third parties whose products you use or are discussed on the Tom’s of Maine Online Community.

You agree that Tom’s of Maine may monitor any discussions, ideas or expressions of opinion exchanged in the Tom’s of Maine Online Community and that selected parts of your personal profile will be available to be seen by other members. Tom’s of Maine may, in its sole discretion, authorize the Provider to suspend or terminate your access to the Tom’s of Maine Online Community if you breach any of these Terms of Use.

You agree to indemnify, defend, and hold harmless each of Tom's of Maine, its parents, subsidiaries, affiliates, officers, directors and employees, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from your use of the Tom’s of Maine Online Community, the violation of these Terms and Conditions by you, or the infringement by you, or any other user using your account, of any intellectual property or other right of any person or entity.

You acknowledge that Tom’s of Maine does not make any representations or warranties to you about any products or services of Tom’s of Maine or any third party that you are asked to use and/or evaluate as part of your membership in the Tom’s of Maine Online Community. You hereby release Tom’s of Maine from any and all liability that may arise in connection with your use of the Tom’s of Maine Online Community. These Terms of Use shall be governed by the laws of the State of Maine.
