  4. 本协议受美国乔治亚州法律约束,并仅按该州法律进行解释,法律冲突原则并不适用。

您声明截止本协议签订之日,您至少年满18 周岁。

如果截止本协议签订之日未年满18周岁,则由您的父母或法定监护人代您接受本协议的条款。

Sie wurden eingeladen, einer Online Community (der „Community“) beizutreten, die Marktforschung für The Coca-Cola Company („Coca-Cola“) betreibt.  Um Mitglied zu werden, müssen Sie die folgenden Bedingungen akzeptieren: 

 

  1. Sie werden bei der regelmäßigen Vergabe von Auszeichnungen für die Teilnahme an der Forschungs-Community berücksichtigt. Coca-Cola vergibt monatlich Preise in Form von Amazon-Geschenkgutscheinen, Paypal-Punkten, Coca-Cola Mitgliederprämien oder Ähnlichem. Diese Preise werden auf elektronischem Weg direkt an Mitglieder der Forschungs-Community vergeben, die bestimmte Aufgaben innerhalb eines festgelegten Zeitrahmens erfüllen. Die Preise können von unterschiedlichem Wert sein und einem Barwert zwischen 3 und 20 EUR entsprechen.  Wann welcher Preis für welche Aufgabe vergeben wird, wird in der Community rechtzeitig bekannt gegeben.

 

  1. Coca-Cola hat die Community entwickelt, damit junge Kunden wie Sie uns ihre Ansichten und Meinungen mitteilen können und Coca-Cola einen besseren Einblick in die Jugendkultur und Ihren Lebensstil gewinnt.  Coca-Cola wird Sie möglicherweise auch nach Ihrer Meinung zu den aktuellen Werbekampagnen befragen. Ziel ist es jedoch nicht, von Ihnen Ideen oder Vorschläge für aktuelle oder zukünftige Produkte, Werbekampagnen, Marketing oder Werbeaktionen von Coca-Cola einzuholen. Falls Sie der Community Ideen oder Vorschläge zukommen lassen oder ihr Materialien wie Grafiken, Videos, etc. zur Verfügung stellen, wird mit diesen wie in Abschnitt 3 beschrieben verfahren.

 

  1. Sie erklären hiermit, Coca-Cola von etwaigen Ansprüchen Dritter, die diese aufgrund der Verwendung etwaig zur Verfügung gestellten Materials geltend machen, – ohne dass es auf ein Verschulden ankommt – freizuhalten, Coca-Cola bei der Rechts­ver­tei­di­gung die notwendige Unterstützung zu bieten und die angemessenen Kosten der Rechts­ver­tei­di­gung zu übernehmen. 
  2. Als Gerichtsstand für alle sich aus oder im Zusammenhang mit dieser Vereinbarung ergebenden Streitigkeiten wird Berlin bestimmt. Für die sich aus oder im Zusammenhang mit dieser Vereinbarung ergebenden Rechtsbeziehungen der Parteien gilt das Recht der Bundesrepublik Deutschland.

Sie versichern, dass Sie zum Zeitpunkt dieser Vereinbarung mindestens 18 Jahre alt sind.

 

Wenn Sie zum Zeitpunkt dieser Vereinbarung nicht mindestens 18 Jahre alt sind, muss ein Elternteil oder Erziehungsberechtigter die Bedingungen dieser Vereinbarung in Ihrem Namen akzeptieren.

Tuttavia, l'obiettivo di Coca-Cola non è cercare di ottenere da te idee o suggerimenti relativi a prodotti Coca-Cola esistenti o futuri, oppure in merito alle sue campagne pubblicitarie, marketing o promozionali future. Se scegli di fornire idee o suggerimenti, oppure di inviare materiali come file di grafica, video, ecc. alla Comunità di ricerca, tali elementi saranno trattati come descritto nel presente Contratto.
  2. In cambio dell'opportunità di ricevere premi di apprezzamento e, in ciascun caso, nella misura massima consentita dalla legge in vigore:
    1. L'utente assegna in modo irrevocabile a Coca-Cola ogni diritto, titolo o interesse, inclusi tutti i diritti di proprietà intellettuale (nella forma di brevetti, marchi, copyright o altri diritti di proprietà intellettuale), per tutti i commenti, suggerimenti, file di grafica, idee (incluse le idee relative a prodotti, pubblicità, marketing e promozioni) e altre informazioni o materiali inviati a Coca-Cola tramite la Comunità di ricerca. 
    2. I lavori inviati diventano di proprietà esclusiva di Coca-Cola, inclusi gli eventuali diritti futuri associati a tali lavori, anche nel caso in cui i termini e le condizioni della Comunità di ricerca vengano modificati o revocati in un secondo momento.
    3. L'utente rinuncia a tutti i diritti di attribuzione e integrità per lavori specifici creati da lui stesso e inviati alla Comunità di ricerca, nel rispetto di tutti gli utilizzi di marketing, pubblicità e commerciali pertinenti. 
    4. L'utente riconosce il diritto di Coca-Cola di utilizzare i lavori (o materiali o idee) con qualsiasi mezzo di comunicazione, attuale o futuro, senza preavviso, compenso o altro obbligo verso l'utente stesso o altre persone.
  1. L'utente riconosce che, ad eccezione delle sue informazioni personali, i lavori non sono materiale riservato e Coca-Cola non è obbligata a considerarli tali. 
  2. Nella misura massima consentita dalla legge in vigore, l'utente rinuncia a qualsiasi richiesta di risarcimento  danni nei confronti di Coca-Cola rispetto a qualsiasi proprietà intellettuale o altri diritti di proprietà, diritti di privacy e pubblicità, diritti di attribuzione, o qualsiasi altra responsabilità ai sensi delle leggi in vigore. 
  3. Il presente Contratto è disciplinato dalle leggi dello Stato della Georgia (USA).  Qualsiasi azione legale relativa al presente Contratto deve essere trattata esclusivamente nello Stato e nelle corti federali di Fulton County, Georgia, USA.  Ciascuna delle parti accetta la giurisdizione di tali corti.   

L'utente dichiara di essere maggiorenne al momento della stipula del presente Contratto.

 

Se l'utente non ha ancora raggiunto i 18 anni di età, il genitore o il tutore legale accetta i termini del presente Contratto per suo conto.

AGREEMENT AND ASSIGNMENT

You have been invited to join an online community providing marketing research (the “Research Community”) for The Coca-Cola Company (“Coca-Cola”).  As a member, you agree to the following: 

  1. You will be eligible to receive periodic appreciation awards for your participation in the Research Community. On a monthly basis, Coca-Cola will give awards in the form of Amazon gift certificates, Paypal credits, Coca-Cola Member Rewards or similar items. These awards are issued electronically and directly to members in the Research Community who complete specified activities within the required timeframe. The awards will vary in value and are expected to be the equivalent of US$5 to US$30 in cash value, calculated at the prevailing exchange rate on the date and time of the award.    

 

  1. Coca-Cola is creating the Research Community to allow young consumers like you to share their perspectives and opinions in order for Coca-Cola to gain a better understanding of teen culture and lifestyles.  Coca-Cola may also seek your feedback about our existing advertising. However, Coca-Cola is not seeking ideas or suggestions from you about Coca-Cola’s existing or future products, or its future advertising, marketing or promotions. If you choose to provide ideas or suggestions, or submit materials such as graphics, videos, etc. to the Research Community, those items will be treated as described in Section 3 below.
  2. In exchange for the opportunity to receive appreciation awards, you irrevocably assign to Coca-Cola all right, title and interest, including all intellectual property rights (whether as to patent, trademark, copyright or other intellectual property rights), to all comments, suggestions, graphics, ideas (including product and advertising, marketing and promotional ideas), and other information or materials you submit to Coca-Cola through the Research Community.  Your submissions will become the exclusive property of Coca-Cola, including any future rights associated with such submissions, even if the terms and conditions of the Research Community are later modified or terminated. To the extent permitted by applicable law, you waive all rights of attribution, and integrity for specific works (otherwise known as “moral rights”) created by you and submitted through the Research Community, in respect of all marketing, advertising and commercial uses thereof.  You acknowledge Coca-Cola’s right to use the submissions (or materials or ideas similar to them) in any medium, now and in the future, without notice, compensation or other obligation to you or any other person. You also agree that with the exception of your personal information, your submissions are not confidential and Coca-Cola has no obligation to keep them confidential. 
  3. You release and waive all claims against Coca-Cola with respect to any intellectual property or other proprietary rights, rights of privacy and publicity, rights of attribution, or any other liability under any applicable laws. 
  4. This Agreement is governed by the laws of the State of Georgia, USA.  Any legal actions pertaining to this Agreement must be adjudicated solely in the state and federal courts situated in Fulton County, Georgia, USA.  Each party consents to the jurisdiction of such courts.   

You represent that you will be at least 18 years old as of the date of this Agreement.

 

If you are not at least 18 years old as of the date of this Agreement, your parent or legal guardian has accepted the terms of this Agreement on your behalf.

  1. Araştırma Topluluğu'na katılımınız nedeniyle belirli dönemlerde takdir ödülleri almaya hak kazanacaksınız. Coca-Cola aylık olarak Amazon hediye sertifikaları, Paypal kredileri, Coca-Cola Üyelik Ödülleri veya benzer formlarda ödüller verecektir. Bu ödüller elektronik ortamda düzenlenmekte ve öngörülen süre içinde belirli aktiviteleri yerine getiren Araştırma Topluluğu üyelerine doğrudan verilmektedir. Ayrıca, kişisel bilgileriniz dışında, sunumlarınızın gizli olmadığını ve Coca-Cola'nın bunları gizli tutma yükümlülüğü olmadığını da kabul etmektesiniz.  

 

3.     Her türlü fikri mülkiyet veya sair mülkiyet hakklarından, gizlilik, kişisel dokunulmazlık  ve yayın hakklarından , eser sahibi olarak adınızın belirtilmesini talep etme hakkından veya ilgili yasalar kapsamındaki başka yükümlülükler açısından Coca-Cola'ya karşı tüm hak taleplerinden feragat etmekte ve Coca-Cola’yı tüm bu hususlara ilişkin olarak ibra etmekte siniz.

AGREEMENT AND ASSIGNMENT

You have been invited to join an online community providing marketing research (the “Research Community”) for The Coca-Cola Company (“Coca-Cola”).  As a member, you agree to the following: 

 

  1. You will be eligible to receive periodic appreciation awards for your participation in the Research Community. On a monthly basis, Coca-Cola will give awards in the form of Amazon gift certificates, Paypal credits, Coca-Cola Member Rewards or similar items. These awards are issued electronically and directly to members in the Research Community who complete specified activities within the required timeframe. The awards will vary in value and are expected to be the equivalent of US$5 to US$30 in cash value.

  2. Coca-Cola is creating the Research Community to allow young consumers like you to share their perspectives and opinions in order for Coca-Cola to gain a better understanding of teen culture and lifestyles.  Coca-Cola may also seek your feedback about our existing advertising. However, Coca-Cola is not seeking ideas or suggestions from you about Coca-Cola’s existing or future products, or its future advertising, marketing or promotions. If you choose to provide ideas or suggestions, or submit materials such as graphics, videos, etc. to the Research Community, those items will be treated as described in Section 3 below.

  3. In exchange for the opportunity to receive appreciation awards, you irrevocably assign to Coca-Cola all right, title and interest, including all intellectual property rights (whether as to patent, trademark, copyright or other intellectual property rights), to all comments, suggestions, graphics, ideas (including product and advertising, marketing and promotional ideas), and other information or materials you submit to Coca-Cola through the Research Community.  Your submissions will become the exclusive property of Coca-Cola, including any future rights associated with such submissions, even if the terms and conditions of the Research Community are later modified or terminated. You waive all rights of attribution, and integrity for specific works created by you and submitted through the Research Community, in respect of all marketing, advertising and commercial uses thereof.  You acknowledge Coca-Cola’s right to use the submissions (or materials or ideas similar to them) in any medium, now and in the future, without notice, compensation or other obligation to you or any other person. You also agree that with the exception of your personal information, your submissions are not confidential and Coca-Cola has no obligation to keep them confidential. 

  4. You release and waive all claims against Coca-Cola with respect to any intellectual property or other proprietary rights, rights of privacy and publicity, rights of attribution, or any other liability under any applicable laws.
     
  5. This Agreement is governed by the laws of the State of Georgia, USA.  Any legal actions pertaining to this Agreement must be adjudicated solely in the state and federal courts situated in Fulton County, Georgia, USA.  Each party consents to the jurisdiction of such courts.   

 

You represent that you will be at least 18 years old as of the date of this Agreement.

 

If you are not at least 18 years old as of the date of this Agreement, your parent or legal guardian has accepted the terms of this Agreement on your behalf.

Has sido invitado a unirte a una comunidad de investigación de mercado (la "comunidad de investigación") de The Coca-Cola Company ("Coca-Cola").  Como miembro de esta comunidad, aceptas lo siguiente:

 

  1. Podrás ser elegido para recibir reconocimientos por tu participación en la comunidad de investigación. Mensualmente, Coca-Cola otorgará reconocimientos consistentes en: certificados de regalo de Amazon, créditos Paypal, artículos promocionales de Coca-Cola o artículos similares. Estos reconocimientos se entregarán electrónicamente y directamente a aquellos miembros de la comunidad de investigación que completen las actividades especificadas dentro del período requerido. Los reconocimientos podrán variarán en valor, que podrá ser el equivalente de entre 5 dólares a 30 dólares en efectivo.
  2. Coca-Cola está creando la comunidad de investigación para permitir a los consumidores jóvenes como tú compartir sus perspectivas y opiniones para que Coca-Cola pueda obtener una mejor comprensión de la cultura de los adolescentes y sus estilos de vida.  Coca-Cola también pretende obtener tus comentarios acerca de nuestra publicidad actual.   Sin embargo, Coca-Cola no busca ideas o sugerencias de ustedes acerca de los productos Coca-Cola existentes o futuras, o su publicidad futura, marketing o promociones. Si decides proporcionar ideas o sugerencias, o presentar materiales tales como gráficos, vídeos, etc. a la comunidad de investigación, esos elementos se tratarán como se describe en la sección 3 infra.
  3. A cambio de la oportunidad de participar en la comunidad de investigación y recibir reconocimientos por tu participación, irrevocablemente otorgas a Coca-Cola, todos los derechos, títulos e intereses, incluidos todos los derechos de propiedad intelectual (ya sea en cuanto a patentes, marcas, derechos de autor u otros derechos de propiedad intelectual), de todos los comentarios, sugerencias, gráficos, ideas (incluyendo productos y su publicidad, mercadotecnia e ideas promocionales) , así como cualquier otra información o material que envíes a la Coca-Cola a través de la comunidad de investigación.  Tus aportaciones serán propiedad exclusiva de Coca-Cola, incluyendo los derechos futuros relacionados con dichos envíos, incluso si los términos y condiciones de la comunidad de investigación son posteriormente modificados o revocados.  Asimismo, renuncias a todos los derechos de autoría  y de la totalidad de las obras específicas creadas por ti, y que fueron enviadas a través de la comunidad de investigación, con relación a toda la mercadotecnia, la publicidad y los usos comerciales de la misma. Asimismo, reconoces el derecho de Coca-Cola de utilizar dichas participaciones (o los materiales o ideas similares a ellos) en cualquier medio, ahora y en el futuro, sin previo aviso, contraprestación o cualquier otra obligación para ti o cualquier otra persona. También aceptas que, con la excepción de tu información personal, los envíos no son confidenciales y Coca-Cola no tiene obligación de mantener su carácter de confidencial.
  4. Renuncias a cualquier reclamación contra Coca-Cola con respecto a cualquier propiedad intelectual o cualquier otro derecho de propiedad, derechos de privacidad y publicidad, derechos de autoría  o cualquier otra responsabilidad bajo las leyes pertinentes.
  5. Las partes acuerdan someterse a las leyes y tribunales de la Ciudad de México, de manera clara e incuestionable, renunciando a cualquier otro fuero que por razón de domicilio presente o futuro o el lugar de cumplimiento o por cualquier otra causa, puede aplicarse.

 

A la firma del presente documento, manifiestas que, cuentas al menos con 18 años de edad.

 

Si no cuentas al menos 18 años de edad a la fecha de firma de esta document, tu padre o tutor legal debe de aceptar los términos y condiciones de este document en tu nombre.
